Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Shotixy platform, operated by Shotixy ("Company," "we," "us," or "our"). By creating an account or using the service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of them, do not use Shotixy.

1. Acceptance of Terms

By accessing or using Shotixy (the "Service"), you confirm that:

• •If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Service Description

Shotixy is an AI-powered product photography platform that allows users to upload product images and generate professional photoshoot results — including studio backgrounds, lifestyle scenes, model shots, and ad creatives.

The Service uses third-party AI providers (including fal.ai and Anthropic) to generate image outputs. The quality and accuracy of generated images depend on the input provided and the capabilities of the underlying AI models.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will make reasonable efforts to notify users of significant changes.

3. User Accounts

To use Shotixy, you must create an account. You are responsible for:

We reserve the right to suspend or terminate accounts that violate these Terms or are found to be fraudulent.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• ✗Upload images that depict illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate images, or content that promotes violence or terrorism
• ✗Upload images to which you do not own the rights or do not have a license to use
• ✗Use the Service to generate deceptive, fraudulent, or misleading content intended to deceive consumers
• ✗Attempt to reverse-engineer, scrape, or extract data from the Service, including using automated tools to collect product data, competitor intelligence, or training data
• ✗Use the Service to build a competing product or service without our written consent
• ✗Share your account credentials or allow others to use your account
• ✗Attempt to circumvent usage limits, payment requirements, or access controls
• ✗Introduce malware, viruses, or other harmful code into the Service

Violation of these rules may result in immediate account suspension without refund.

5. Intellectual Property

Your Content

You retain all ownership rights in the product images you upload ("Input Images"). By uploading images to the Service, you grant Shotixy a limited, non-exclusive license to process those images solely for the purpose of generating your photoshoot outputs.

Generated Images

You own the images generated by Shotixy from your inputs. We grant you a perpetual, worldwide, royalty-free license to use, reproduce, distribute, and sell the generated images for any commercial or non-commercial purpose, including use in online marketplaces (Amazon, Etsy, Shopify, Trendyol, Hepsiburada, etc.) and advertising.

We do not claim any ownership rights over your generated images. We do not use your generated images in our marketing without your explicit permission.

Shotixy Platform

The Shotixy platform, including its software, design, trademarks, and content (excluding User Content), is owned by Shotixy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the platform without our written permission.

6. Payment and Subscriptions

Free Trial

New users receive 3 free photoshoots upon registration. No credit card is required for the free tier.

Paid Plans

Paid subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. All prices are listed in USD unless otherwise indicated.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have paid for.

Refunds

We offer a 7-day refund window for new subscriptions. If you are dissatisfied with the Service within 7 days of your first paid charge, contact support@photoai.co for a full refund. After 7 days, payments are non-refundable except where required by applicable law.

Price Changes

We may change subscription prices with at least 30 days advance notice. Continued use of the Service after the effective date of a price change constitutes acceptance of the new price.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHOTOAI AND SELLSHOTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) generated images will meet your specific requirements or be suitable for any particular platform's policies; or (c) defects will be corrected.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Indemnification

You agree to indemnify, defend, and hold harmless Shotixy, Shotixy, and their officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your account immediately, without prior notice, if:

• •You breach these Terms
• •Your payment fails and is not resolved within a reasonable period
• •We detect fraudulent activity or abuse
• •We are required to do so by law

You may terminate your account at any time by deleting it from account settings or contacting support@photoai.co. Upon termination, your access to the Service ends and your data will be deleted according to our data retention policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, unless otherwise required by local mandatory law.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via email or in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the new Terms, you must stop using the Service.
